Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BreachVex website, waitlist, and pentest scanning service (collectively, the "Service"). By using the Service, you accept these Terms. If you do not agree, please do not use the Service. For information on how we process your personal data, see our Privacy Policy.

1. Description of the service

BreachVex provides: (a) a public marketing website, (b) a waitlist allowing you to register interest in early access, and (c) an upcoming AI-driven blackbox penetration-testing platform that orchestrates automated security scans of web applications. Service features are described on the website and may evolve over time. Until the general availability announced on our website, access to the scanning platform is provided in closed beta / evaluation mode. Beta features may be modified, suspended, or removed without prior notice. No service-level agreement or uptime commitment applies during the beta period.

2. Eligibility

You must be at least 18 years old and have legal capacity to enter into a contract. If you use the Service on behalf of a company, you represent that you are authorised to bind that entity to these Terms. The Service is intended for professional and business use only. By using BreachVex, you represent that you are accessing the Service in the course of your trade, business, craft, or profession and not as a consumer within the meaning of EU Directive 2011/83/EU or French Code de la consommation.

3. Authorisation — mandatory scope

Penetration testing without authorisation is illegal in most jurisdictions (e.g. Computer Fraud and Abuse Act in the US, Article 323-1 of the French Code pénal, Computer Misuse Act 1990 in the UK). You agree that, before initiating any scan, you will provide express written authorisation to test the target — and that you own the target or have explicit permission from its owner. You alone are responsible for the legality of the scans you launch.

All content, software, branding, and detection logic provided by the Service remain the exclusive property of BreachVex. Scan reports we generate for you (findings, proofs of exploit) belong to you — subject to our right to retain anonymized telemetry for service improvement.

6. Limitation of liability

To the maximum extent permitted by applicable law, BreachVex's total cumulative liability arising out of or related to the Service is limited to the greater of: (a) one hundred euros (€100), or (b) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. We exclude all indirect, incidental, consequential, or punitive damages, including lost profits, lost data, and reputational harm. Nothing in these Terms limits liability that cannot be excluded under French law (e.g. gross negligence, wilful misconduct, death or personal injury).

7. No warranty

The Service is provided "as is" and "as available". We make no guarantee that scans will detect every vulnerability, that the Service will be uninterrupted, or that results will be free from error. Security testing is by nature probabilistic. Proof-of-concept code, exploit demonstrations, and remediation snippets included in scan reports are provided exclusively for use in authorised security testing and remediation contexts. BreachVex does not endorse or authorize use of this material against systems for which you lack explicit written permission.

8. Scan side-effects disclaimer

Active security scanning may cause unintended effects on the target system, including temporary performance degradation, WAF rule triggering, intrusion detection alerts, or unexpected behavior on misconfigured systems. BreachVex is not liable for any disruption, downtime, or third-party consequence caused by scans you initiate against targets you have authorised. You are responsible for coordinating scan timing with target operators when required.

9. Indemnification

You agree to indemnify, defend, and hold harmless BreachVex and its operator from any claim, liability, damage, cost, or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your selection of scan targets; (c) any breach of these Terms; or (d) any claim that a scan you initiated was unauthorised or caused harm to a third party.

10. Force majeure

BreachVex is not liable for any failure or delay in performing its obligations caused by events beyond its reasonable control, including but not limited to: internet infrastructure failures, third-party service outages (cloud hosting, database, AI inference providers), denial-of-service attacks against BreachVex infrastructure, regulatory action, government order, natural disaster, or force majeure as defined by French Code civil Article 1218.

11. Termination

You may stop using the Service or unsubscribe from communications at any time. We may suspend or terminate your access immediately if you breach these Terms, abuse the Service, or expose us to legal risk. On termination, sections that by their nature should survive (IP, liability, governing law) remain in force.

12. Governing law and jurisdiction

These Terms are governed by French law. Any dispute that cannot be resolved amicably will be brought before the competent courts of Paris, France, subject to mandatory consumer protections in your country of residence.

13. Updates to these Terms

We may amend these Terms. The current version is dated below. Material changes will be announced on the website and, where applicable, communicated by email at least 30 days in advance.
